Terms of Service

1. Introduction

Welcome to Kasuki ("the Bot"), a Discord bot created by Valgul. These Terms of Service ("Terms") govern your access to and use of Kasuki, including any associated services, features, content, and websites (collectively, the "Service"). By adding Kasuki to your Discord server or using the Service in any way, you agree to be bound by these Terms.

2. Basic Terms

2.1. You must be at least 13 years old and comply with Discord's Terms of Service to use Kasuki.

2.2. You are responsible for all activity that occurs under your account or on your Discord server related to the use of Kasuki.

2.3. You may not use the Service for any illegal or unauthorized purpose, including but not limited to violation of any laws in your jurisdiction.

2.4. You agree to provide accurate information when using the Service, particularly when registering AniList accounts with the bot.

3. User Content and Conduct

3.1. You are solely responsible for your conduct and any data, text, files, information, usernames, images, or other content that you submit, post, or display through Kasuki.

3.2. You must not modify, adapt, or hack Kasuki or attempt to breach any security or authentication measures.

3.3. You must not intentionally overload or flood the Service with requests, or introduce malicious code or viruses into the Service.

3.4. You must not use Kasuki for spamming, harassment, or any abusive behavior as outlined in the bot's Code of Conduct.

4. API Usage and Rate Limits

4.1. Kasuki connects to various third-party APIs including AniList, Steam, and potentially AI services based on configuration. Your use of the Service is also subject to the terms of service of these third-party providers.

4.2. The Service implements rate limits to ensure fair usage. Premium limits may apply to certain AI-based features as described in the documentation. Attempting to circumvent these limits is prohibited.

5. Self-Hosting

5.1. Kasuki is available for self-hosting under the Apache License 2.0. If you choose to self-host the bot:

5.1.1. You must comply with the terms of the Apache License 2.0.

5.1.2. You are responsible for your own infrastructure, security, and compliance with applicable laws.

5.1.3. Official support is only provided for the current master version and dev version.

5.1.4. You must not use Kasuki's name, logo, or identity in a way that suggests your self-hosted instance is the official bot without explicit permission.

6. Service Availability and Modifications

6.1. The Service is provided "as is" without warranties of any kind, either express or implied.

6.2. We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

6.3. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

7. Third-Party Services and Content

7.1. The Service may contain links to third-party websites, services, or other content that are not owned or controlled by Kasuki's creator.

7.2. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and privacy policies of any third-party websites or services that you visit or use.

8. Limitations of Liability

8.1. To the maximum extent permitted by applicable law, in no event shall Kasuki, its creator, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

8.1.1. Your access to or use of or inability to access or use the Service;

8.1.2. Any conduct or content of any third party on the Service;

8.1.3. Any content obtained from the Service; and

8.1.4. Unauthorized access, use, or alteration of your transmissions or content.

9. Indemnification

9.1. You agree to defend, indemnify, and hold harmless Kasuki, its creator, and contributors from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Changes to Terms

10.1. We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

10.2. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

11. Governing Law

11.1. These Terms shall be governed and construed in accordance with applicable international laws, without regard to its conflict of law provisions.
